The Supreme Court has set the date to deliver judgment in a suit filed by the People’s Democratic Party (PDP) against Bola Tinubu and Kashim Shettima as presidential and vice-presidential candidates of the All Progressives Congress (APC), respectively.

The court will on May 26, 2023, give its judgment on the suit
seeking the disqualification of Tinubu and Shettima.

The PDP claimed that Shettima’s nomination as Tinubu’s running mate was in breach of several provisions of the Electoral Act 2022, including sections 29(1), 33, 35, and 84(1)(2).

The party argued that Shettima’s nomination to contest for the position of Vice-President and Borno Central Senatorial District seat at the same time contravened the law.

The PDP sought an order disqualifying the APC, Tinubu, and Shettima from contesting the presidential election and also sought an order nullifying their candidacies.

However, Justice Inyang Ekwo of the Federal High Court dismissed the suit because the PDP lacked the locus standi to institute the suit. Not satisfied, the PDP appealed the judgment.

The Court of Appeal, led by Justice James Abundaga, also dismissed the appeal by PDP because the party failed to establish its locus standi to institute the case.

The three-member panel of the Court of Appeal held that the PDP was a busybody, who meddled in the internal affairs of the APC.

Justice Abundaga, in his ruling, described the PDP’s actions as unnecessary and irrelevant to the case at hand. The judge dismissed the appeal, stating that the PDP had no legal standing to bring the case to court.
