Supreme Court Voids Peter Nwaoboshi's Conviction, Orders Release

The Supreme Court has voided Senator Peter Nwaboshi’s (Delta North) fraud and money laundering conviction and seven-year imprisonment sentence.

Daily Report Nigeria reports that the apex court also ordered Nwaboshi’s immediate release from the Ikoyi Prison, where he was being held.

In its ruling on Friday, the Supreme Court also pardoned two companies, Golden Touch Construction Project Ltd and Suiming Electrical Ltd, who were in court with him on two counts brought by the Economic and Financial Crimes Commission (EFCC).

In another four-one decision, the Supreme Court overturned the July 1, 2022 ruling of the Lagos Court of Appeal that overturned the Lagos Federal Court’s acquittal.

In a key ruling by Justice Emmanuel Agim, the Supreme Court ruled that Nuwaobisi and both companies were wrongfully and maliciously prosecuted by the EFCC for not committing crimes known to the law, and unnecessary criminal charges related to civil transactions.

He was sentenced to have been subjected to proceedings. The EFCC had accused Nwaboshi and his company of illegally acquiring a property called Guinea House on Marine Road in Apapa, Lagos state for N805 million.

The anti-corruption agency claimed part of the money paid for the property was sent by Suiming Electrical Ltd on behalf of Nwaoboshi and Golden Touch Construction Project Ltd, and said the money was proceeds from their illegal activities.
