Court Dissolves 7-Year-Old Marriage Over ‘Desertion’

A Jos Area Court sitting in Gwong, Plateau State, has divorced Sumaiya Muhammad and her husband, Bala Usman, on the grounds of desertion.

In granting Muhammad’s request, Judge Ishaq Danjuma stated that all efforts to reconcile the parties had failed.

The judge ordered the petitioner to refund N50,000 only to the respondent, which was Usman’s dowry paid through Khul’l (dissolution of the marriage bond at the wife’s request) in accordance with Islamic law and procedure.

Danjuma also agreed to give the petitioner custody of their children.

He did, however, state that the respondent is free to visit the children at any time during the day.

Previously, Muhammad petitioned the court to dissolve her marriage, claiming that her husband abandoned her while she was ill and living with her parents.

Usman was accused by Muhammad of failing to provide for the family for three years since she became ill.
