Caster Semenya won a landmark ruling when Europe’s top human rights court declared her Swiss trial unfair.

The ECHR found that Swiss judges failed to give her the thorough legal review she deserved when she challenged rules forcing her to lower naturally high testosterone levels to compete as a woman.

Since 2018, the double Olympic 800m champion has been barred from her signature event after refusing hormone treatment under World Athletics’ regulations.
The court found that Caster Semenya was denied the fair trial protections promised under the European Convention on Human Rights and ordered Switzerland to pay her €80,000 to cover legal expenses.
Although it dismissed her discrimination claims as outside Swiss jurisdiction, previous rulings by the Court of Arbitration for Sport (2019) and the Swiss Federal Court (2020) remain in force.
