Court Bars Rivers Chief Judge From Acting On Fubara Impeachment

A Rivers State High Court sitting in Port Harcourt has issued an interim order restraining the Chief Judge of the state, Justice Simeon Chibuzor Amadi, from receiving or acting on any communication from the Rivers State House of Assembly concerning the impeachment of Governor Siminalayi Fubara and his deputy, Prof. Ngozi Nma Odu.

The order was granted by the Oyibo Local Government Area High Court following two separate suits filed by the governor and his deputy, marked Suit Nos. OYHC/7/CS/2026 and OYHC/6/CS/2026.

In the ruling delivered by Justice F. A. Fiberesima, the court also restrained the Speaker of the House, Martin Amaewhule, the Clerk of the Assembly, the Chief Judge, and 31 other defendants from taking any further steps to advance the impeachment process.

Justice Fiberesima specifically barred the Chief Judge for a period of seven days from receiving, considering, forwarding, or acting on any resolution, impeachment notice, or request aimed at constituting an investigative panel to probe the alleged misconduct of the governor and his deputy.

The court, while granting the applications ex parte, authorised the claimants to serve the court processes on the defendants by pasting them at the gate of the Rivers State House of Assembly Quarters, while service on the Chief Judge is to be effected through any judiciary staff member at his chambers.

The matter has been adjourned to January 23, 2026, for the hearing of the motion on notice, as the legal battle over the impeachment of Governor Fubara and his deputy continues to deepen.
