Justice Emeka, presiding over the case, issued the order on October 27 while ruling on an ex-parte motion filed by the Deputy Governor with suit number FHC/ABJ/CS/2219/2025. The Bayelsa State House of Assembly and its Speaker were listed as respondents in the matter.

The Deputy Governor approached the court seeking an order restraining the Assembly from initiating any impeachment action over his refusal to defect from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) before the end of his current tenure. He argued that such pressure amounted to an attempt to unlawfully remove him from office.

In the same suit, Dr Ewhrudjakpo also asked the court to restrain the Inspector-General of Police, the Director of the Department of State Services, and the Bayelsa State Attorney-General from withdrawing his official security protection pending the determination of the substantive motion.

Justice Emeka ordered the Bayelsa Assembly and its Speaker to appear before the court to show cause why they should not be stopped from initiating any impeachment move against the Deputy Governor.

The matter has been adjourned to November 13, 2025, for the hearing of the motion on notice for interlocutory injunction.
