Despite Protest, Reps Adopt Senate’s Version on Electronic Transmission

The House of Representatives on Tuesday rescinded its earlier position on Clause 60(3), adopting the version earlier passed by the Senate of Nigeria.
The decision allows both electronic and manual transmission of election results.
The approval followed an emergency sitting of the House.
Opposition lawmakers protested the move and staged a walkout from the chamber, chanting “APC, ole” in disapproval.
The House had earlier adopted a stricter provision mandating electronic transmission of results from each polling unit to the IREV portal after the prescribed Form EC8A had been signed and stamped by the presiding officer and countersigned by candidates or polling agents where available.

However, the adopted Senate version introduced a caveat.
Under the revised clause, the presiding officer is to electronically transmit results to the IREV portal after completing and signing Form EC8A.
“Provided that if the electronic transmission of the result fails as a result of communication failure and it becomes impossible to transmit the result contained in Form EC8A signed and stamped by the Presiding Officer and countersigned by the candidates or polling agents where available at the polling unit, the Form EC8A shall remain the primary source of collation and declaration of the result,” the provision states.
The amendment effectively recognises manual documentation as the fallback mechanism in cases of technical failure.
The development comes amid ongoing deliberations on amendments to Nigeria’s electoral framework ahead of future polls.
