Mazi Nnamdi Kanu, leader of the outlawed Indigenous People of Biafra (IPOB), has filed a Motion on Notice at the Court of Appeal, Abuja Division, requesting that further proceedings in his trial before Justice James Omotosho of the Federal High Court be temporarily halted.
According to court documents obtained from his Special Counsel, Barrister Aloy Ejimakor, Kanu personally filed the application seeking to restrain the trial court from delivering judgment scheduled for November 20, 2025.
“The trial court refused to evaluate the evidence of the prosecution witnesses vis-à-vis cross-examination questions, and also declined to rule on the jurisdiction and validity of the counts under which the Appellant is being tried,” Kanu stated in the petition.

Kanu argued that although he submitted a list of witnesses for his defense, the trial court foreclosed this right, stating that the court would only address objections during judgment.
He emphasized that proceeding without resolving these matters could lead to an unlawful conviction, denying him the opportunity to defend the case fully.
“Further proceedings on the matter will stultify the Appellant’s right of appeal and any appellate decision,” Kanu said, noting that the case has been ongoing since 2015.
Kanu requested that the appellate court grant the motion, asserting that doing so would serve the interest of justice and ensure the case is examined on its merits.
