Trader alleges unlawful account freeze prevented him from paying father’s hospital bills

Seeks declaration of rights violation, ₦50 million in damages, and public apology
A Lagos-based trader, Moses King, has filed a suit against Opay Digital Service Limited at the Federal High Court, claiming the fintech company unlawfully froze his account (No: 8087652738) without a court order.
The suit, marked FHC/L/CS/178/2026, was filed through his lawyer, Barrister Olalekan Ogunbunmi, under the Fundamental Rights (Enforcement Procedure) Rules, 2009, citing Sections 34, 36, 43, and 44 of the 1999 Constitution of Nigeria.

According to court documents, the account was placed on Post No Debit (PND) from September 17 to December 9, 2025.

King alleges that this restriction prevented him from accessing ₦500,000 needed to pay his father’s hospital bills; his father had been hospitalized since September 10, 2025, and later died on December 15, 2025.
In his claim, King seeks:Declaration that the account freeze was illegal and unconstitutional, ₦50 million in exemplary damages. An order for Opay to publish a public apology in two national newspapers
King submitted a 23-paragraph affidavit stating that he had no history of fraud or illegal activity, and that the freeze caused severe hardship, forcing him to rely on neighbours for food.
He also claimed that Opay attributed the freeze to an internal report, without showing any court order.
Justice Daniel Osiagor has fixed March 2, 2026, for the hearing of the case.
