A prominent Nigerian lawyer, Adebayo Adenipekun, SAN, has taken legal action against human rights advocate Dele Farotimi, filing a suit at the Oyo State High Court in Ibadan.

Adenipekun, in a court document dated December 9, 2024, demanded that Farotimi appear before the court within 30 days.

The legal tussle, which has drawn significant attention, lists Adenipekun as the claimant, with Farotimi and his publishing company, Dele Farotimi Publishers, named as the first and second defendants.

According to the court document, Farotimi is required to make an appearance in the case, and failure to do so may result in a default judgment in Adenipekun’s favour.

The writ of summons, served in accordance with legal procedures, demands Farotimi’s presence in court and outlines a strict timeline for compliance.

It reads: “You are hereby commanded that within 30 (thirty) days of the service of this writ on you, inclusive of the day of such service, you do cause an appearance to be entered for you in an action at the suit of Adebayo Adenipekun, SAN, and take notice that in default of your doing so, the Claimant may proceed therein, and judgment may be given in your absence.”

The legal action comes amidst ongoing legal battles for Farotimi, who has also been entangled in a defamation case filed by legal heavyweight Afe Babalola, SAN.

Farotimi, who is facing multiple charges in the Ekiti State Magistrate Court, pleaded not guilty to 14 charges brought against him earlier this week. Despite the growing public outcry, a ruling on his bail application was adjourned until December 20, 2024.

His counsel, Adeyinka Olumide-Fusika (SAN), has submitted a preliminary objection to the Ekiti court, challenging the defamation suit filed by Babalola.

The objection, filed on December 9, 2024, urges the court to dismiss the case.
