Legal debates trail governor’s suspension during emergency rule
The Peoples Democratic Party (PDP) has sent a strong message to Rivers State Governor, Mr Siminalayi Fubara, demanding loyalty and renewed commitment to peace as he resumes office following the expiration of the six-month emergency rule.
Deputy National Legal Adviser of the PDP, Mr Okechukwu Osuoha, said the governor’s return must mark a fresh phase of stability and reconciliation, stressing that accountability and steadfast loyalty to the party remain crucial.

He explained that Fubara’s suspension stemmed from the emergency declaration imposed by President Bola Tinubu in March, adding that with no extension granted, the governor is now constitutionally bound to resume duty.
“The issue is that there was an emergency declaration by the President, constitutionally, which is allowed. He has to come back to the office because the suspension was for six months, and there has been no extension. Therefore, he must return and assume his role as executive governor of Rivers State,” Osuoha said.
He acknowledged concerns over the legality of suspending an elected governor during emergency rule but insisted that Fubara’s reinstatement should usher in reconciliation.
According to him, unity between the governor and the State Assembly, as well as with political benefactors, is necessary to restore peace in the oil-rich state.

“Every Nigerian expects a cordial relationship between the executive and the legislative arms of Rivers State, between the governor and the House of Assembly,” Osuoha stated, urging Fubara to mend fences with his political godfathers to enable development.
Osuoha stressed that the PDP remains supreme, calling on Fubara to actively participate in party affairs and reaffirm his loyalty.
“He is still a member of the PDP and should participate fully in party affairs. Party is supreme. If you have any problem, the party will come to your rescue and support you,” he said.
