The Socio-Economic Rights and Accountability Project (SERAP) has initiated a contempt lawsuit against Professor Mahmood Yakubu, the Chairman of the Independent National Electoral Commission (INEC), for failing to act on allegations of electoral offences from the 2023 general elections.

The alleged offences include bribery, vote-buying, and misconduct reportedly involving state governors and their deputies.

This legal action follows a Federal High Court ruling by Justice Obiora Atuegwu Egwuatu on July 18, 2024, which ordered INEC to investigate these allegations and appoint independent counsel for the prosecution of suspects.

Despite the court’s directive, INEC has yet to take necessary steps, prompting concerns about potential imprisonment for Professor Yakubu due to contempt of court.

In a statement released on October 27, SERAP’s Deputy Director, Kolawole Oluwadare, condemned INEC’s inaction, stressing that neglecting court orders undermines Nigeria’s rule of law.

He urged the commission to tackle the persistent electoral misconduct that threatens credible elections and democracy.

Justice Egwuatu’s ruling highlighted the severe impact of electoral violence on Nigeria’s democratic and economic landscape.

Citing relevant sections of the Electoral Act and the Constitution, he affirmed INEC’s duty to prosecute electoral offenders to safeguard citizens’ rights.

SERAP’s lawsuit, filed under the provisions of the Sheriff and Civil Process Act, seeks to compel INEC to comply with the court’s orders. As of now, a hearing date for the contempt suit has not been established.
