Tribunal Nullifies PDP House of Assembly Election, Declares APC Winner

The Zamfara State Election Tribunal has nullified the election of the state Assembly Member representing Bungudu West, Basiru Bello Auki.

Auki was elected on the platform of the People’s Democratic Party, the PDP.

The court annulled his election on Thursday in Sokoto following a ruling by a panel of three judges.

According to the court, the reason for the annulment of the election was because the fired legislator refused to resign as a civil servant working with the Bungudu local government council thirty days before the election day going by Section 107(1) (f) Constitution of the Federal Republic of Nigeria 1999 (as amended).

It read:

No person shall be qualified for election to a House of Assembly if he is a person employed in the public service of the Federation or of any State, and he has not resigned, withdrawn or retired from such employment thirty days before the date of the election.”

The court asserted that the petitioner, Basiru Lawal Bungudu, who appeared on the All Progressives Congress, APC platform of the Progressives General Assembly, was able to prove his case beyond a reasonable doubt.

The petitioner’s lawyer, Solicitor Ibrahim Ali, presented to the court evidence of the last paycheck the fired lawmaker received from the Bungudu local government council even after his election.
