Again, Aisha Binani Sues INEC Over Election Nullification

Adamawa State’s gubernatorial candidate on March 18, Aisha Dahiru, known as Binani has again sued the Independent National Electoral Commission (INEC).

Daily Report Nigeria that the electoral umpire had nullified her declaration as the state’s governor after the last supplementary election.

Dahiru opposed the Adamawa gubernatorial election on the platform of the All Progressives Congress, APC.

The Candidate through her lawyer, Michael Ondaka, SAN, filed a new lawsuit before Judge Donatus Okowo of the Federal High Court in Abuja.

In the ex-parte motion marked: FHC/ABJ/CS/935/2023, INEC, the Peoples Democratic Party, PDP, and its candidate, Governor Ahmadu Fintiri we’re sued as first, second, and third respondents respectively.

She again asked the court to reconsider the electoral arbitrator’s decision to annul her previous ballot-winner declaration by Hudu Yunusa-Ari, the Adamawa State’s Resident Electoral Commissioner, REC.

On Monday, Aondoaka moved the motion and argued on behalf of Dahiru that the Electoral Petitions Tribunal has the power to decide the fate of his client under Section 149 of the 2022 Elections Act.

He maintained that INEC’s decision would be stripped of her rights under Section 285(6), which can be waived 180 days from the lawsuit he filed in court on May 6.

The lawyer informed the court that although a similar case had been filed before Judge
Inyang Ekwo, the sister court asked Binani to head to the tribunal for her case as it was an election-related one.

He said that an undertaking was signed to prove to the court that the current lawsuit was not frivolous and that they were willing to pay any costs if the court finds the case to be frivolous.

After hearing Andoaka, Okorowo adjourned the case on July 18 for hearing and ordered the defendants to state their reasons why the court should not accept Dahiru’s reliefs.
